Dad obtains custody after mother takes kids out of state

Child custody arrangements can sometimes be difficult to determine when a divorce has not yet been finalized. It's important not to remove your children from their home state, though, unless the other parent has given permission. Doing this can make it appear like you're trying to separate your children from your spouse, and unless there is a good reason to do so, it can lead to troubling legal consequences.

The father of a child who was attacked and sexually assaulted in the woods in Arlington has been given custody of the little girl. According to the Nov. 10 news, the father had been in a custody dispute with his wife when the incident occurred, and both had injunctions against each other.

The court ruled that the mother had violated the court's orders by taking the couple's children out of the state of Florida and moving to a new location. Now, the father is being allowed custody to take the kids back to their home state. They are currently in North Carolina, where their father will need to appear to pick them up.

In Aug. 2015, the man's daughter was attacked near the couple's apartment in Arlington. The 8-year-old girl had just recovered from her injuries when her mother took her kids out of the state and away from her husband. He has been pursuing them ever since, and he says he hasn't seen his 8-year-old daughter since three days following the attack.

The attacker was never caught, but that did not give the mother the right to flee with the children. Once the girls are returned to Florida, the divorce of the couple will continue and custody can then be arranged and determined based on the facts of the case. Presently, this is a pick-up order, which means the children have to be returned to their home state.
